Public Offer

1. Terms and Definitions

• Seller — Individual Entrepreneur "Nova Trade" (IE "Nova Trade"), registered in accordance with the legislation of the Republic of Kazakhstan, selling Goods through the Online Store.
• Buyer — any natural or legal person possessing the required legal capacity who has accepted the terms of this Offer (made an Acceptance).
• Online Store (Website) — the official website of the Seller located at https://cleverbricks.shop, intended to showcase Goods and process Orders.
• Goods — plastic building sets, STEM kits, children's products, and scale models offered for sale on the Website.
• Order — a duly submitted request by the Buyer for the purchase and delivery of Goods selected on the Website.
• Acceptance — full and unconditional acceptance of the terms of this Agreement by the Buyer by performing the actions specified in Section 2 of this Agreement (Article 396 of the Civil Code of the Republic of Kazakhstan).

2. General Provisions and Acceptance of the Offer

2.1. Placing an Order or paying for Goods on the Website cleverbricks.shop by the Buyer constitutes a full and unconditional Acceptance of this Public Offer.

2.2. By making an Acceptance, the Buyer confirms that they have read, understood, and fully agreed to all terms and conditions of this Agreement, as well as the Privacy Policy, Shipping Policy, and Return Policy.

2.3. The Seller reserves the right to amend this Agreement at any time without prior notice. The revised version of the Agreement becomes effective immediately upon publication on the Website.

3. Subject Matter of the Agreement

3.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

3.2. This Agreement governs the sale and purchase of Goods through the Online Store, including:

• independent selection of Goods by the Buyer on the Website;
• processing of electronic payments by the Buyer;
• delivery and fulfillment of the Order to the Buyer.

4. Ordering and Pricing

4.1. The Buyer places Orders independently on the Website through the Shopping Cart.

4.2. Product prices are displayed on the Website in Kazakhstani Tenge (KZT), US Dollars (USD), and Euros (EUR) depending on the currency selected by the Buyer. Final charges are processed in the chosen currency or converted according to the exchange rate of the Buyer's card issuing bank at the time of transaction.

4.3. Product prices indicated on the Website may be changed unilaterally by the Seller prior to Order placement and payment.

4.4. Shipping fees are not included in the price of the Goods and are calculated separately at checkout based on the destination country, region, and selected delivery service.

4.5. For international shipments, the Buyer is solely responsible for paying any import customs duties, taxes, and fees required under the laws of the destination country.

5. Payment Terms

5.1. Payment for Goods is made on a 100% advance payment basis via cashless methods using credit or debit cards (Visa, Mastercard, etc.) through authorized payment services (acquiring).

5.2. Payment security and confidentiality are guaranteed by the processing center of the acquiring service provider. The Seller does not store or process cardholder banking data.

5.3. The Buyer's payment obligation is deemed fulfilled upon successful receipt of funds into the Seller's account or payment authorization by the acquiring system.

6. Delivery and Transfer of Goods

6.1. Delivery of Goods is carried out worldwide via international postal services and local or international courier services specified during checkout.

6.2. Estimated delivery timeframes are non-binding and may vary depending on the country of destination, customs processing, and operational conditions of logistics carriers.

6.3. Title and risk of accidental loss or damage to the Goods pass to the Buyer upon actual delivery of the Goods to the Buyer or the designated logistics carrier.

7. Returns and Exchanges (Consumer Protection)

7.1. Returns and exchanges of Goods are processed in accordance with the Law of the Republic of Kazakhstan "On Protection of Consumer Rights".

7.2. Return of non-defective Goods (Proper Quality):

• The Buyer has the right to exchange or return non-defective Goods within 14 (fourteen) calendar days from the date of receipt.
• Returns of Goods of proper quality are accepted only if the items retain their original condition, consumer properties, undamaged original packaging, factory seals/labels, and proof of purchase.
• Return shipping costs for non-defective Goods are the sole responsibility of the Buyer.

7.3. Return of defective Goods (Improper Quality):

In the event of a manufacturing defect or missing components, the Buyer has the right to request a product replacement, defect rectification, or a full refund.

7.4. Refunds will be issued to the original bank card used for the transaction within 5 to 10 business days after the returned Goods are received and inspected by the Seller.

8. Personal Data Processing

8.1. In accordance with the Law of the Republic of Kazakhstan "On Personal Data and Its Protection", by placing an Order, the Buyer consents to the collection and processing of their personal data (full name, delivery address, contact phone number, email) by the Seller for the purpose of fulfilling this Agreement.

8.2. The Seller undertakes not to transfer received personal data to third parties, except for courier and logistics services directly involved in fulfilling and delivering the Order.

9. Liability and Dispute Resolution

9.1. The Parties shall be held liable for failure to perform or improper performance of their obligations under this Agreement in accordance with the legislation of the Republic of Kazakhstan.

9.2. Any disputes or disagreements arising between the Parties shall be settled through negotiations and written claims. The timeframe for reviewing a claim is 10 (ten) business days.

9.3. If an agreement cannot be reached through negotiations, the dispute shall be submitted to the competent courts at the Seller's place of registration in Almaty, Kazakhstan, under the governing laws of the Republic of Kazakhstan.
